The mindsprings.in (“Website”) is a domain owned and operated by Mindsprings Publishing, a proprietorship business under the laws of India.This User Agreement (“Agreement”) sets out the terms and conditions on which Mindsprings Publishing shall provide the Services to the Users through the Website. The Users shall be deemed to have read, understood and accepted this Agreement, which may be updated or modified by MINDSPRINGS PUBLISHING from time to time.The use of the Website is offered to the Users conditional on acceptance without modification of all the terms, conditions and notices contained in this Agreement and as may be posted on the Website from time to time.

This Agreement shall be effective and binding upon Users’ ‘acceptance’. ‘Acceptance’ shall mean Users’ affirmative action in clicking on “I have read the Terms and Conditions and I accept them” box and on the Submit button as provided on the registration page. For removal of doubts, it is clarified that use of the Website by the Users constitutes an acknowledgement and acceptance by the Users of this Agreement. If the Users does not agree with any part of such terms, conditions and notices, the Users must not use the Website.

MINDSPRINGS PUBLISHING at its sole discretion reserves the right not to facilitate acceptance of any request by the users for listing, display or offering any products and services through the website without assigning any reason thereof. Any contract to provide any product or service by MINDSPRINGS PUBLISHING is not complete until the entire consideration towards the product or service is received by MINDSPRINGS PUBLISHING.

We at MINDSPRINGS PUBLISHING have made every possible effort to display the products that appear on the site as accurately as possible.

MINDSPRINGS PUBLISHING provides no warranty, either expressed or implied with respect to any product, and specifically disclaims all other warranties, including, without limitation, warranties for merchantability, non-infringement and fitness for any particular purpose.

MINDSPRINGS PUBLISHING’s sole obligation and liability for product defects shall be, at MINDSPRINGS PUBLISHING option, to replace or issue store credit only against any manufacturing defect (Manufacturing defect will be solely decided by MINDSPRINGS PUBLISHING) to buyer. In no event shall MINDSPRINGS PUBLISHING liability exceed the buyer’s purchase price.

MINDSPRINGS PUBLISHING reserves the right to refuse or cancel any order placed for a product that is listed at an incorrect price or for any other reason. This shall be regardless of whether the order has been confirmed and/or payment been received. The payment shall be refunded and the User shall be informed of the same. In this case no restocking fees would be charged.

MINDSPRINGS PUBLISHING will not be liable for any type or kind of credit card fraud. The liability to use a card fraudulently will be on the user and the onus to ‘prove otherwise’ shall be exclusively on the user. The User must exclusively use his/her own card on the site at the time of purchase.

The prices and availability of products are subject to change without prior notice at the sole discretion of MINDSPRINGS PUBLISHING so no disputes shall be entertained.
